In paragraph 15 of their "DECISION ON APPLICATION FOR REVIEW", the Tribunal wrote
"… the employers did, as we found, consult with the applicant after he raised objections to the original draft policy prior to the August edition being published."
Apparently, although employers must consult employees when terms and conditions of employment are changed, it does not matter whether the consultation takes place before or after the policy is implemented. That may be news even to some lawyers.
