What Does Grattan Plc Mean by "Random"?
Before I resigned, I doubted that Grattan’s searches were genuinely random, except in the sense that individuals were often stopped without reasonable suspicion. For that reason, when writing letters to Grattan plc, I often put the word "random" in quotes. However, in my discussions with Grattan plc, I was not able to get a clear definition of what the company meant by "random". The Tribunal had more luck in that regard. I quote from paragraph 4 of the Tribunal’s decision: -
"It was explained to us that ‘random’ meant that a certain class of employee would be stopped by almost a random selection process, for instance, those wearing red jumpers".
Some purists may doubt that it really is "almost a random selection process". If choosing a class of employees with red jumpers is a random selection, then choosing a class of employees with red hair is a random selection. If choosing a class of employees with red hair is a random selection, then choosing a class of employees with black hair is a random selection. If choosing a class of employees with black hair is a random selection, then choosing a class of employees with…etc.
A lay member of the Tribunal tried to question Grattan’s witness on the subject of inappropriate search criteria, but the Chairman said that he didn’t want to "go down that road". For that reason, I did not question the witness on that subject myself, even though I had planned to.
However, I would have had misgivings even if the searches had been genuinely performed at random.
